دور المحكمة الدستورية في تعزيز دعائم الامن القانوني

الملخص
يعتبر مبدأ الأمن القانوني من بين أهم المبادئ الدستورية في وقتنا المعاصر والتي أخضعها المؤسس الدستوري إلى الرقابة من جانب القاضي الدستوري،الذي يملك السلطة التقديرية لكي يقرر دستورية نص قانوني أو تنظيمي من عدمه،وهذا كله بهدف حماية مبدأ الأمن القانوني من أي مساس أو تجاوز،وهذا ما عمد إليه المؤسس الدستوري الجزائري على غرار العديد من التشريعات المقارنة،وذلك من خلال إعطاء كل الصلاحيات والآليات اللازمة للمحكمة الدستورية لتحقيق ذلك من خلال آلية الإلغاء سواء الإلغاء الكلي للنص وهذا ما جسده التعديل الدستوري لسنة 2020 صراحة بأن قرارات المحكمة الدستورية نهائية وملزمة لجميع السلطات العمومية، أو الإلغاء الجزئي له فقط وهنا يتقيد القاضي الدستوري بإبطال النص الغير دستوري والإبقاء على النصوص الدستورية الأخرى ،وكذا آلية التحفظات التفسيرية ومالها من أنواع سواء التحييدية أو التقييدية أو حتى الآمرة. Abstract: The principle of legal security is one of the most important constitutional principles of today's times, which the constitutional founder has censored by the constitutional judge, who has the discretion to determine the constitutionality of a legal or regulatory text, all of which is aimed at protecting the principle of legal security from any prejudice or abuse Algeria's Constitution is similar to many comparative legislation, by giving all the necessary powers and mechanisms to the Constitutional Court to achieve this through the mechanism of annulment of both the total repeal of the text. This is clearly reflected in the Constitutional Amendment of 2020 that the decisions of the Constitutional Court are final and binding on all public authorities, or the partial abrogation thereof Only here is the Constitutional Judge bound by nullifying the unconstitutional text and retaining other constitutional texts, as well as the mechanism of interpretative reservations and their purview of types, whether neutral, restrictive or even peremptory.
