الملخص : من الشائع أن تلجأ الحكومات إبان الإضطرابات و التوترات الداخلية إل اتخاذ خطوات تعلق بموجبها بعض الحقوق. و في المقابل توسع من صلاحيات أجهزتها الأمنية على حساب حقوق و حريات الأفراد بموجب ما يسمى بأعمال السيادة ، التي تسخرها الحكومات بغرض احتواء الفلتان الأمني، إلا أن هذه الإجراءات قد تفتح المجال أمام ممارسات تعسفية في حق الأفراد دون الخضوع لأية سلطة رقابية . رغم أن كل من ميثاق الأمم المتحدة والإعلان العالمي لحقوق الإنسان يؤكدان على احترام كرامة الإنسان وسلامته، في حالات العنف والاضطرابات والتوترات الداخلية، والخطر العام الاستثنائي، إلا أنها أثبتت عدم كفايتها وقصورها في حماية الإنسان . resume Il est courant que les gouvernements prennent des mesures pendant les troubles et les tensions internes pour suspendre certains droits.
