الخصاص العقاري بالمناطق الريفية ومشاريع التنمية المستديمة: دراسة في اشكالية الملكية العامة والخاصة "أرياف ولاية ميلة أنموذجا"

الملخص
يسعى صاحب هذه الورقة البحثية للنبش في إشكالية من الإشكاليات ذات الصلة بقضايا التنمية في الجزائر بكل مناحيها والمشاكل التي تعيق سبيل القائمين عليها. ويتعلّق الأمر بشكل مركّز في مسعانا البحثي هذا؛ بمسألة التنمية المستديمة بالمناطق الريفية بولاية ميلة وأزمة العقار (الأرض) بها؛ أي مشكلة إيجاد أوعية عقارية كفيلة بتجسيد مشاريع التنمية وتلبية حاجات تلك المناطق في شتى مناحي الحياة وقطاعات التنمية سيّما بالمناطق الجبلية أو شمال الولاية، على ضوء الاستثمار الأمثل للعقار الموجود وحسن استغلاله؛ من خلال تفعيل القوانين الناظمة لمسألة الملكية الخاصة للأراضي بهذه المناطق الريفية والأراضي التابعة لأملاك الدولة، وضبط مسائلها المتشعّبة: من تعويض مالي لأصحاب الملكية الخاصة، والاسترجاع السلس للأراضي العمومية التي يستغلّها الخواص دون صبغة قانونية، واستثمارها فيما يتناسب وطبيعة النشاط التنموي بالريف، فلاحي كان أو صناعي أو خدماتي. The author of this research paper aims at studying one of the problems related to the development issues in Algeria in all its aspects, and the problems that impede the people in charge of it. In our research endeavor, this relates particularly to the issue of sustainable development in rural areas in Mila and the crisis of the estate (land) in there. i.e, the problem of finding real estate investors to concretize the development projects, and to respond to the needs of those areas in all aspects of life and sectors of development, especially in mountainous areas or upstate, in the light of the best investment of the existing estate and its proper exploitation; through the enforcement of the laws that govern the issue of private ownership of land in these rural areas and the land belonging to the state property, and the control of its manifold problems, such as: the monetary compensation to the owners of private properties, the restitution of public lands exploited by private property owners without legalization and to invest it in proportion to the development activity in the county side, be it agricultural, industrial or service activity.
