الملخص
هذه رسالة مخطوطة للشيخ امحمد بن يوسف اطفيش الجزائري، في موضوع حكم الحشيشة التي تعد نوعا من المخدرات والدخان والسعوط جوابا عن سؤال سأله عنه أهل فاس بالمغرب وكذلك أهل تلمسان بالجزائر، فكان نعم الجواب وبيان حكم هذه البلوى التي ابتليت بها البشرية لفترة طويلة وإلى يومنا هذا، وما تزال الظاهرة في انتشار وتزايد بخاصة في المجتمعات العربية والإسلامية، فكان لزاما بيان حكم الشرع فيها بالاجتهاد في إطار النصوص الشرعية قرآنا وسنة. وعلى ضوء ذلك فإن الرسالة المؤلفة تكتسي أهمية معتبرة بكونها تراثا مغاربيا ودراسة جزائرية سباقة في تناول هذا الموضوع في جانبه الفقهي ومحاولة البحث في حكمه وتأصيله باعتباره مسألة فقهية نازلة في حياة المسلمين خلال القرن التاسع عشر. خاصة بعد تفشي هذه الظاهرة وبيان ما تلحق من أضرار على جسد الإنسان تؤدي في كثير من الأحيان إلى فقه روحه وإزهاق نفسه إن هو تمادى في تناول هذه الأمور والإفراط فيها. فكان لزاما على الفقهاء وعلماء الشريعة بحث أدلتها وعرض براهينها وبيان خطورتها وآثامها في حق الأفراد والجماعات ومختلف شرائح المجتمع. فكان هذا المقال الذي تناول جانب الدراسة وجانب التحقيق متبعا العناصر الآتية: 1 ـ ترجمة مختصرة للمؤلف 2 ـ دراسة المخطوط: ـ ضبط العنوان ـ مصادر ومراجع المخطوط ـ سبب تأليف المخطوط ـ التعريف بالنسخ الموجودة 3 ـ تحقيق المخطوط ـ الجزء الأول: حكم الحشيشة: ضبط لغة النص وتخريج آياته وأحاديثه وأقواله والتعليق عليها. ـ الخاتمة وعرض النتائج This is a manuscript letter by Sheikh Mhamed bin Youssef Tfayesh Al-Jazaery, on the subject of the rule of hashish, which is a kind of drug, smoke and snuff, in answer to a question asked by the people of Fez in Morocco, as well as the people of Tlemcen in Algeria, and it was a yes answer and a statement of the ruling of this affliction that has plagued humanity for a long time and to this day And the phenomenon is still spreading and increasing, especially in Arab and Islamic societies, so it was necessary to explain the Sharia ruling in it by ijtihad within the framework of the legal texts of the Qur’an and Sunnah. In light of this, the authored thesis is of considerable importance as it is a Maghreb heritage and a pioneering Algerian study in dealing with this issue in its jurisprudential aspect and an attempt to research its ruling and rooting it as a jurisprudential issue descending in the lives of Muslims during the nineteenth century. Especially after the spread of this phenomenon and the clarification of the damage inflicted on the human body, which often leads to the understanding of his soul and the loss of himself if he goes too far in dealing with these matters and exaggerating them. It was necessary for the jurists and scholars of Sharia to examine its evidence, present its evidence, and clarify its dangers and sins against individuals, groups and various segments of society. This article dealt with the study side and the investigation side, following the following elements: 1- A short translation by the author 2 – Study of the manuscript: Address setting Manuscript sources and references The reason for writing the manuscript Identification of existing copies 3- Realization of the manuscript Part one: The rule of marijuana: controlling the language of the text, extracting its verses, hadiths and sayings, and commenting on them.
