المعالجة القانونية لخطاب الكراهية بين التشريعات المحلية الجزائرية والاتفاقيات الدولية

الملخص
ملخص: خطاب الكراهية الذي أصبح مثار جدل ونقاش في الآونة الأخيرة بين رجال القانون، هو في الأصل ليس موضوعا جديدا، بل له جذور تاريخية تمتد إلى عمق الوجود البشري، وقد عالجته الأديان والعلاقات الإنسانية القديمة كظاهرة اجتماعية مرتبطة بالسلوك، ولم يعالج بالشكل الذي نحن عليه إلا بعد أن أصبح ظاهرة خطيرة، تتخلل مختلف المعاملات البشرية، سيما بعد التقارب الذي فرضته التكنولوجيا على البشر، حيث يبدو الإنسان متعاونا إلى حد ما، وبمجرد أن تتعارض المصالح، وتتدخل الأهواء حتى يهرول إلى الوراء ويستنجد بما أوتي ليحقق التجميع الكافي على أسس مختلفة –دين- عرق – لون- لغة...، بما يضمن له تحقيق المواجهة واستمرارها، التي تجني على الجميع الويلات الكثيرة، لذلك كان لزاما على المشرع أن يتدخل لوضع ضوابط، ويضع حدودا كفيلة باستمرار التعاون بين البشر، ومحاربة كل ما من شأنه أن يعكر الصفو العام، بالكلمة أو الصورة أو الانتماءات المختلفة، بما يعبر عنه بخطاب الكراهية عموما. Abstract: Hate speech, which has become the subject of controversy and debate in Recently among jurists, is not originally a new topic, but rather has historical roots that extend to the depths of human existence. Religions and ancient human relations have treated it as a social phenomenon linked to behavior, and it has not been treated in the way we are until after It has become a dangerous phenomenon that permeates various human transactions, especially after the rapprochement imposed by technology on humans, where man appears to be cooperative to some extent, and once interests conflict, and whims interfere until he rushes back and seeks help from what he has been given to achieve sufficient collection on different bases " religion - Race - color - language...ect", in a way that guarantees the achievement and continuation of confrontation, which reaps many scourges on everyone, so it was necessary for the legislator to intervene to set controls, and set limits that would ensure the continuation of cooperation between human beings, and to combat everything that would disturb the public peace by word, image, or different affiliations, including hate speech in general.
