مظاهر القضاء الاداري في ظل ازدواجية القضاء في الجزائر

الملخص
الملخص: لقد عرفت الجزائر نقلة نوعية في مجال حماية الحقوق والحريات الاساسية للأفراد تجسيدا للديمقراطية وتفعيلا لدولة القانون . حيث اقر المشرع الجزائري في الدستور سنة 1996 نظام ازدواجية القضاء باستحداثه هيئة قضائية عليا جديدة تفصل في المنازعات الإدارية وذلك وفقا للمادة 152 منه و التي تنص "يؤسس مجلس الدولة كهيئة مقومة لأعمال الجهات القضائية الإدارية" هذه المادة معدلة بموجب المادة 171 من دستور 2016، إضافة إلى ذلك أنشئت هيئة قضائية فاصلة في نزاعات الاختصاص بين القضاء العادي و القضاء الإداري و هي محكمة التنازع. و من المادة 152 السالفة الذكر استمدت المحاكم الإدارية وجودها القانوني كدرجة أولى للتقاضي في المنازعات الإدارية. ومن خلال هذا وجب علينا في هذا البحث دراسة مظاهر ازدواجية القضاء في التشريع الجزائري الكلمات المفتاحية: ازدواجية القضاء المحاكم الادارية مجلس الدولة محكمة التنازع Algeria has witnessed a qualitative leap in the field of protecting the basic rights and freedoms of individuals, embodying democracy and activating the rule of law. Whereas the Algerian legislator approved in the constitution in 1996 the system of dual judiciary by creating a new supreme judicial authority to settle administrative disputes, in accordance with Article 152 of it, which states, “The State Council is established as a body evaluating the work of the administrative judicial authorities.” This article is amended by Article 171 of the 2016 Constitution, In addition, a judicial panel was established to settle jurisdictional disputes between the ordinary judiciary and the administrative judiciary, which is the Dispute Court. And from the aforementioned Article 152, the administrative courts derive their legal existence as the first degree of litigation in administrative disputes. Through this, we must study in this research the manifestations of the duality of the judiciary in the Algerian legislation key words: Dual Judiciary Administrative Courts State Council Court of Dispute
