علم الميزان وأثره في الفقه القضائي

الملخص
تناولت الدراسة إبراز أثر علم الميزان، في حسم الكثير من المسائل القضائية المستجدة،من خلال التأصيل له وبيان أهميته وأسسه التي يرتكز عليها، بغية الوصول إلى الرأي السديد الموافق لمقاصد الشريعة، ولما كان القضاء من أروع النظم تحقيقا للأهداف سامية، والغايات النبيلة، يعصم الدماء ويصون الأبضاع، وميدان لفصل الخصومات وفض النزاعات، كان لزاما على القاضي أن يحصل قواعد علم الميزان ومسالكه، من أجل تصوير المسألة والإحاطة بها من كل جوانبها والنظر في مآلاتها، ولتحقيق هذا الغرض تم استثمار قواعده من خلال نماذج تطيقية من الإجتهاد القضائي،الموسوم "بالخلع القضائي" واخضاعه لقواعد علم الميزان ومسالكه مع إبراز ممكن الخلل والإضظراب في الإجتهاد القضائي الجزائري. this monograph studied the impact of scale science in resolving many of the emerging judicial issues through rooting it and showing its importance and its foundations in order to reach the good opinion corresponding to the purposes of Sharïa and since the judiciary is one of the finest systems in order to achieve the high goals and noble purposes ; stopping blood and safeguarding vulva and a field for the adjudicate of deductions and dispute resolution ; the judge had to obtain the rules of scale science and its methods in order to illustrate the issue and surround it in all its aspects and consider its outcomes and to achieve this purpose it has been invested through applied models of judicial jurisprudence marked by judicial women divorce and subjecting it to the rules and paths of scale science, while highlighting the flaws and disturbances in Algerian jurisprudence
