الملخص
ملخص : استحدث المؤسس الدستوري بموجب التعديل الدستوري آلية الدفع بعدم دستورية القوانين التي سمحت بإقرار وجود سلطة للمواطن في الدفاع عن الحقوق والحريات الأساسية مما يساهم في تعزيز مفهوم المواطنة، عن طريق توسيع حق الاخطار الى الأفراد لدفع بعدم دستورية أي نص قانوني يمس بالحقوق والحريات، وفقا لأطر وضوابط قانونية محددة، حددها القانون العضوي 18/16 المتضمن شروط وكيفيات تطبيق الدفع بعدم الدستورية Abstract: Under the constitutional amendment, the constitutional founder created a mechanism for pushing the unconstitutionality of laws that allow the recognition of the citizen's authority to defend his or her basic rights and freedoms, which contributes to strengthening the concept of citizenship, by expanding the right of notification for individuals to back the unconstitutionality of any legal text that affects rights and freedoms, in accordance with frameworks and controls Specific legal, defined by Organic Law 18/16 containing the terms and conditions for applying the unconstitutionality payment
