المحكمة الجنائية الدولية (نحو الرهان على تكريس واقع عدالة جنائية منصفة) The Future ,support And Enhancement Alternatives To The Work Of The Court

الملخص
بعد كل هذه السنوات من دخول المحكمة الجنائية حيز النفاذ، إلا أنها لم تسلم من الانتقادات التي طالتها حتى قبل ممارستها لعملها القضائي، ما أبقى الدول في مصاف المراقب لأوضاعها ليبقى الأمل قائما في مدى تحقيقها لأهدافها، الأمر الذي يستدعي تقييم عملها لأجل الوقوف على ما تحقق من نتائج ايجابية،بالأخص في ظل ما يعرف- بمأزق العدالة الدولية- حين تنفرط فيها المقدمات القانونية السليمة، وتتحكم في سيرها ما يصطلح عليه (بالعواطف السياسية)و(السلوكيات النفسية)، بما يقوض في العمق مبدأي (اللاتمييز وكونية العدالة). هنا يبدو السؤال ملحا عن آفاق ومستقبل هذه المحكمة، كآلية قانونية لضمان تحقيق عدالة جنائية دولية منصفة، تضمن حماية المتابعين وتعويض الضحايا، في ضوء ذلك يهدف الموجز الوافي للحزمة البحثية إلى عرض ورصد تقييمي بشان المستقبل الذي تتطلع إليه المحكمة في سبيل تحقيق ما يروج له حول فكرة كونية العدالة المبنية على فهم شمولي لحقوق الإنسان، وانسجامها مع كافة المتطلبات السياسية والاجتماعية والثقافية ، وعن احتمال إمكانية عرقلة التوجه نحو مراكمة القوة القانونية السياسية والعسكرية على الصعيد الدولي في الواقع، استقلال عمل آلية عهد لها بتنفيذ القضاء العالمي،وعن ا لبديل الاستراتيجي لتعزيز ودعم عملها، تتمحور الدراسة . Abstract: After all these years when the court enter into force ,and all the experiences of criminal courts that preceded it, however it was not immune from the criticism, even before practicing its judicial work, so states stayed in the position of observer to the court situations in such way that hope remains in achieving its goals. Accordingly, which is required is the evaluation of the court work in order to stand on positive results that have been achieved; especially under what is known as; (the impasse of international justice),when good legal premises are lost ,and it will be controlled by political emotions and psychological behaviors’, which will undermine the two principles ; non –discrimination and the universality of justice. Here, the question appears urgent about the horizons and the future of this court as a legal mechanism to ensure the establishment of fair criminal justice that guarantees protecting responsible and compensating victims. Infect, its goal is realizing international standards of justice with legal and acceptable forms by the international community and internally (within the country). Here, the question seems urgent about the prospects and future of this court, as a legal mechanism to ensure the achievement of equitable international criminal justice, ensuring the protection of followers and compensation for victims. The idea of the universality of justice based on a holistic understanding of human rights, its consistency with all political, social and cultural requirements, and the possibility of impeding the trend towards accumulating political and military legal power at the international level.
