الملخص

هدفت هذه الدراسة بشكل عام إلى تسليط الضوء على التقنين الدستوري للمسؤولية الوزارية في دساتير دول مجلس تعاون الخليج العربية، وذلك باتباع المنهج الوصفي التحليلي، والمنهج المقارن للتعرف على أوجه الاتفاق والاختلاف بين الأنظمة الدستورية لدول الخليج العربية في تنظيمها وتقنينها للمسؤولية الوزارية، وقد خلصت الدراسة إلى مجموعة من النتائج، أهمها: اتفاق دساتير دول الخليج العربية على عدم مسؤولية رئيس الوزراء أمام البرلمان بأي حال من الأحوال، باستثناء أن المشرع الكويتي قد قصر ذلك بمنح البرلمان الحق في تقرير عدم التعاون مع رئيس الوزراء، وهو أيضاً ما أخذ به المشرع البحريني، والمشرع القطري إلى حد ما، كما اتفقت معظم دساتير دول الخليج العربية على تنظيم آليات وإجراءات المسؤولية الوزارية الجنائية والمدنية في قوانين خاصة بمساءلة ومحاكمة الوزراء This study aimed, in general, to shed light on the constitutional codification of ministerial responsibility in the constitutions of the Arab Gulf Cooperation Council countries, by following the descriptive analytical approach, and the comparative approach to identify the points of agreement and differences between the constitutional systems of the Arab Gulf countries in their organization and legalization of ministerial responsibility. A set of results, the most important of which are: the agreement of the constitutions of the Arab Gulf states that the Prime Minister is not responsible before Parliament in any way, except that the Kuwaiti legislator has limited this to granting Parliament the right to decide not to cooperate with the Prime Minister, which is also what the Bahraini legislator and the legislator have taken To some extent, the constitutions of the Arab Gulf states have agreed to organize the mechanisms and procedures of criminal and civil ministerial responsibility in laws related to the accountability and trial of ministers.
