بنية الفعل الإجرامي عند الجماعة الإجرامية دراسة الحالة في حي سيدي سالم -ولاية عنابة نموذجا-

الملخص
يتضمن الموضوع دراسة ميدانية لبنية الفعل الإجرامي عند الجماعة الإجرامية في حي سيدي سالم-ولاية عنابة-نموذجا، تعتبر ظاهرة اجتماعية ارتبطت بمختلف المجتمعات بالرغم من اختلاف قيمها ومعاييرها وقواعدها الاجتماعية، والجزائر واحدة من المجتمعات التي مستها هذه الظاهرة، يتطلب البحث في مختلف المستويات المرتبطة بأشكال التنظيم الاجتماعي والتي يراها "دوركايم " جزء من النظام الاجتماعي ترتبط به فهي دائمة بدوامه ومستمرة باستمراره، قمت بهذه الدراسة العلمية الميدانية لألقي الضوء على مدى الانعكاسات التي تطرأ على هذه الظاهرة وذلك لتوضيح العلاقة الثنائية بين (البنية-الفعل) للجماعات الإجرامية، إذ قمت بإتباع المنهج "الوصفي التحليلي " باستخدام تقنية "دراسة الحالة" ،بحيث تمثل العينة "عينة قصدية" تتكون من خمس حالات من مجتمع الدراسة" حي سيدي سالم "، ومن بين أدوات جمع البيانات استخدمت "الملاحظة بالمعايشة" و دليل "المقابلة المعمقة"، ومن بين النتائج المتوصل إليها لإبراز العلاقة بين البنية والفعل الإجرامي كانت على النحو التالي: أن للبيئة الاجتماعية الفقيرة و المهمشة دور في بناء الفعل الإجرامي لأن الفرد يكتسب سلوكاته من الجماعات التي يعيش معها (الوسط الاجتماعي). أن تدهور الوضع الاقتصادي والاجتماعي والثقافي و السياسي يؤدي إلى الانحراف والجريمة، بالتالي تتشكل جماعات إجرامية مختصة في ارتكاب مختلف الجرائم كتنظيم الهجرة الغير شرعية عبر قوارب الموت، بيع المخدرات، جرائم السرقة. أن بنية الفعل الإجرامي للجماعات الإجرامية تتشكل وفقا للنظام الاجتماعي من خلال وجود علاقة ترابطية بين البنية المسؤولة عن عملية تنظيم أشكال النظام الاجتماعي وبين الفعل الإجرامي. :Abstract The topic includes a field study of the structure of the criminal act of the criminal group in the neighborhood of Sidi Salem - Annaba state - a model, which is considered a social phenomenon associated with various societies despite their different values, standards and social rules, and Algeria is one of the societies affected by this phenomenon. The social organization, which Durkheim sees as part of the social system, is linked to it, as it is permanent in its permanence and continuous in its continuity. The “analytical descriptive” approach using the “case study” technique, so that the sample represented an “intentional sample” consisting of five cases from the study community “Sidi Salem neighborhood”, and among the data collection tools we used “observation by living” and the “in-depth interview” guide. Among the results obtained to highlight the relationship between the structure and the criminal act were as follows: The poor and marginalized social environment plays a role in building the criminal act because the individual acquires his behavior from the groups with which he lives (the social milieu). The deterioration of the economic, social, cultural and political situation leads to delinquency and crime, and thus criminal groups are formed specialized in committing various crimes such as organizing illegal immigration through death boats, selling drugs, theft crimes. That the structure of the criminal act of criminal groups is formed according to the social system through the existence of an interconnected relationship between the structure responsible for the process of organizing the forms of the social system and the criminal act.
