إشكالات نوازلية

الملخص
يلحظ المتتبع لما كتب حول موضوع النوازل أنّ جل الإنتاج المتعلق به يتراوح ما بين التحقيق العلمي والدراسات التاريخية، وهي بدون شك خدمات قيمة في بابها وأعمال تستحق التنويه والتشجيع، ولا يستطيع أحد أن يبخسها حقها ولا قدرها، إلا أن الذي تبرز إليه الحاجة اليوم -أكثر من أي وقت مضى- هو تجلية بعض الإشكالات النوازلية والمرتبطة أساسا بالمحددات المنهجية في هذه النوازل الفقهية. ومن الإشكالات التي تعترض الباحث في التراث النوازلي ما يتعلق أولا بالمحددات المنهجية والتي من شأنها أن تحد من الأداء الوظيفي لهذه المؤلفات النوازلية، ثم مدى إمكانية تحويل هذا التراث النوازلي إلى قواعد وآليات منهجية يعول عليها في صناعة الفتاوى الفقهية المعاصرة، ومحاولة ترشيدها لتحقيق الغاية منها، وكيف يمكن للفقيه المعاصر أن يستغل مناهج الافتاء المختلفة والمبثوثة في النوازل الفقهية، ويذيبها في قالب معرفي ومنهجي يستلهم به آليات، فقه الاجتهاد البياني ثم الاجتهاد التنزيلي في القضايا والمستجدات المعاصرة ؟. Abstract: The follower of what has been written about the subject of calamities that most of the production related to it ranges between scientific investigation and historical studies, which are undoubtedly valuable services in its door and actions worth mentioning and encouragement, and no one can underestimate the right and the value, but that the need arises today - more Ever - is the manifestation of some of the problems of the neolithic and related mainly to the methodological determinants in these jurisprudential tendencies. One of the problems faced by the researcher in the heritage of the Nile, what is related to the first methodological determinants, which would limit the functional performance of these works of royalty? Then how far can this heritage be converted to the rules and mechanisms of methodology and skill is reliable in the manufacture of contemporary jurisprudence, and try to rationalize to achieve the purpose? How does the modern jurist exploit the various methods of infidelity that are published in the jurisprudential fictions and dissolve them in a cognitive and methodological form inspired by the mechanisms of jurisprudence and jurisprudence, and then Ijtihad in contemporary issues and developments ?
