الملخص
تعالج هذه الورقة البحثية موضوع نقل وزراعة الكبد في جسم الإنسان، وذلك من خلال بحثها فقهيا لأجل بيان الأحكام الشرعية المتعلقة بها، بداية من وضع تصور طبي لهذه التقنية، ثم ذكر مراحلها وخطواتها، وعرض أهم أحوالها وصورها المختلفة، ثم يكون بعد ذلك تنزيل الأحكام وفق مقاصد الشريعة الإسلامية، مع بيان آراء العلماء في كل مسألة، وذكر أدلتهم ومستنداتهم الفقهية، ثم مناقشها ونقدها في كل صورة، سواءً أكان المعطي والآخذ مسلما أو كافرا، معصوم الدم أو مهدوره، بالإضافة إلى النظر في عملية النقل، إذا كانت في حال الحياة أو الممات، ثم الكلام عن نقل الكبد من الميت دماغيا؛ لنخلص في الأخير إلى ذكر الرأي المختار. Abstract: This research paper deals with the issue of liver transplantation and transfer in the human body through its jurisprudential research to clarify the legal rulings related to it, starting with a medical conception of this technique, then mentioning its stages and steps, presenting the most critical conditions and its various forms, and then downloading the rulings according to The purposes of Islamic Sharia, with a statement of the opinions of scholars on each issue, and mentioning their evidence and jurisprudential documents, then discussing and criticizing them in every form, whether the giver and the taker are Muslim or infidel, infallible blood or wasted, in addition to considering the transfer process, if it is in the state of life or death, then talk about transferring the liver from the brain dead; To conclude in the end to mention the opinion chosen.
