الملخص
ملخص إن الاهتمام بفئة الاطفال ادى بمختلف التشريعات القانونية، إلى إستحداث قضاء للأحداث له فلسفة خاصة تختلف عن تلك التي تتبعها المحاكم العادية المختصة بمحاكمة البالغين ، تقوم على حماية الطفل باعتباره إنسانا قاصرا يجب تقويمه وتوجيهه قبل أن يصبح مجرما، وتعتبر اتفاقية حقوق الطفل لسنة 1989 المرجع في ذلك، أين تم النص على ضرورة النظر في قضايا الأطفال في خطر من طرف قضاة متخصصين بالأحداث، وهذا الاهتمام الدولي انعكس على التشريعات الداخلية للدول من بينها الجزائر التي صادقت عليها بموجب المرسوم الرئاسي رقم 92/461 المؤرخ في 19 ديسمبر1992 ،لذا أصدر المشرع قانون خاص بحماية الطفل رقم 15/12 المؤرخ في 15 يوليو 2015 حيث أقر حماية اجتماعية للطفل المعنف من خلال إنشاء هيئة وطنية لحماية وترقية الطفولة وإنشاء مراكز اجتماعية على المستوى المحلي، كما نص على حماية قضائية تتجسد في تدخل قاضي الأحداث لحماية الطفل المعرض للخطر. Abstract: The interest in the category of children led to the various legal legislations, to the creation of a juvenile justice that has a special philosophy that differs from that followed by the ordinary courts specialized in trying adults. The ruling in the case. The Convention on the Rights of the Child 1989 for the year 1989 is the reference in that, where it was stipulated that cases of children at risk should be considered by judges specialized in juveniles, and this international concern was reflected in the internal legislation of countries Among them is Algeria, which ratified it under Presidential Decree No. 92/461 of December 19, 1992. Therefore, the legislator issued Child Protection Law No. 15/12, where it approved social protection for the abused child through the establishment of a national body for the protection and promotion of childhood and the establishment of social centers at the local level. It also stipulated judicial protection embodied in the intervention of the juvenile judge to protect the child at risk.
