الملخص
ملخص: تعد الحياة الخاصة حق من الحقوق الأساسية للإنسان لارتباطها بكرامته وقيمته المادية والمعنوية، وهذا الحق أقرته التشريعات ووضعت له حماية قانونية ومنها المشرع الجزائري في قانون العقوبات، وفي ظل التطورات الحاصلة في المجال التكنولوجي أصبحت الحياة الخاصة مهددة بالخطر، من جراء الممارسات اللامشروعة التي تقع على البيانات الشخصية، وخصوصية الأفراد مثل الجرائم الماسة بالشرف واعتبار الأشخاص عن طريق نشرها عبر مختلف شبكات التواصل الاجتماعي كالاعتداء بالمساس بالحق في الصورة عن طريق نشرها بشكل سيء، فيتعرضون لجرائم أخرى تهدد حياتهم كالتشهير والابتزاز، وقد تدخل المشرع الجزائري لتوفير الحماية القانونية للحياة الخاصة وفقا للقوانين والاتفاقيات Abstract: The private life is one of the basic rights of the humanbeing due to itsconnectionwithhisdignity and material and moral value, and this right has been approved by legislation and legal protection has been established for him, including the Algerian legislator in the Penal Code, and in light of developments in the technologicalfield, private life has becomethreatened, as a result of illegal practices thatfall on data. Personality, and the privacy of individualssuch as honor crimes and considering people by publishingthemthroughvarious social networks such as assaulting the right to the image by publishingitbadly, sothey are exposed to other crimes thatthreatentheirlivessuch as defamation and extortion, and the Algerian legislator has intervened to providelegal protection for private life in accordance withlaws and conventions.
