مظاهر إهتمام المشرع الجزائري بالبيئة

الملخص
أن الدولة الجزائرية قطعت شوطا كبيرا في مجال إعداد ترسانة قانونية بيئية وتطبيقها بدأتها بإنضمامها إلى الجهد الدولي وتجاوبت مع الاهتمام العالمي بمسائل وقضايا البيئة، كما قننت هذا الاهتمام في الدساتير المختلفة والذي يظهر الأهمية الكبيرة التي حضيت بها البيئة في الجزائر، إلى جانب النصيب الكبير لها من خلال التشريعات القانونية المختلفة التي حاولت مواجهة كل الصعوبات والتهديدات التي تعترض طريقها كاملة . ولتجسيد هذه السياسات تم تحديث وتطوير الإطار المؤسساتي ووضع برامج للتكوين حيث دعمت الجزائر جهدها الدستوري والقانوني بجهد مؤسساتي توّج بإنشاء وزارة خاصة بالبيئة، بعد مرحلة عدم الإستقرار والتذبذب في العشرية السابقة وتناوب بين مختلف الدوائر الوزارية وهذا راجع لعدم اهتمام الحكومة بسياسة البيئة، كما أن التدهور البيئي عائد إلى فشل خطط التنمية التي أغفلت إدخال الاعتبارات البيئية في مشاريعها التنموية والإقتصادية Résumé L’etat algérien a fait de grands progrès dans le domaine de la préparation et de la mise en œuvre d’un arsenal juridique environnemental, qu’il a commencé par rejoindre l’effort international car il a codifié cet intérêt dans les différentes constitutions, ce qui montre la grande importance que l’environnement a eu en Algérie. Afin d’incarner ces politiques, le cadre institutionnel a été actualisé et développé , ont été élaborés, l’algerie a accompagné ses efforts constitutionnel et juridiques par un effort institutionnel qui a abouti à la création d’un ministère spécial chargé de l’environnement après la phase de l’instabilité et l’alternance entre les différents départements ministériels, cela est du au désintérêt du gouvernement pour la politique environnementale, et l’échec des plans de développement qui ont négligé d’inclure les considérations environnementales dans leur projets économiques Abstract The algerian state has mode great strides in the field of preparing and implementing ou environmental legal arsenal which it started by joining the international effort and has gone begond with global interest in environmental issues. It also condified this interest in the different constitutuions, which shows the great importance. In order to implement these policies, the institutional frame work has been updated and eveloped as algeria supported its constitutional and legal efforts with an institutional effort culminated by the establisement of a special ministry for the environment after the stage of instability and dealt with varios ministerial departements, and this is due to the government’s lack of interest in environmental policy and the failure of development plans that neglect to include environmental considerations in their development and economic projects .
