الملخص
:Abstrac Tthis study aims to monitor the march against the death penalty at the international and regional levels, based on the controversy surrounding it between its supporters and opponents, and what they relied on to justify their positions on it which moved to the United Nations, which adopted the opposition within its framework, its quest to strengthen and promote human rights, following the gradual method, by restricting the number of executions in a first step, through to the endeavor to completely abolish them through agreements that establish obligations for ratified countries to abolish them from their internal legislation. It was a model that the opposition followed its approach at the regional level.The study concluded that thanks to the unremitting international efforts in this field, the death penalty has become a punishment rejected by the international. As a result of these efforts, legal safeguards for the application of the death penalty have been established for countries that retain the death penalty, and to prevent extrajudicial, or eexecutions with concise or arbitrary procedures.. Resume :cette étude vise à suivre la marche contre la peine de mort aux niveaux international et régional, à partir de la polémique qui l'entoure entre ses partisans et ses opposants et ce sur quoi ils se sont appuyés pour justifier leurs positions à son sujet, qui a été transmise aux Nations unies, qui a adopté l'opposition dans son cadre, sa quête pour promouvoir et promouvoir les droits de l'homme, en suivant la méthode progressive de Pendant la réduction des cas d'exécution dans un premier temps, en essayant de les abolir complètement par des accords qui établissent des obligations pour les pays ratifiants de les abolir de leur législation interne, c'était un modèle que l'opposition a suivi son approche au niveau régional. L'étude a conclu que grâce aux efforts internationaux inlassables dans ce domaine, la peine de mort est devenue une peine rejetée par la communauté internationale, et à la suite de ces efforts, des garanties juridiques ont été établies pour l'application de la peine de mort pour les pays qui maintenir la peine de mort et empêcher les exécutions extrajudiciaires ou sommaires ou arbitraires. الملحص : تهدف هذه الدراسة إلى رصد مسيرة المناهضة لعقوبة الإعدام في المستوى الدولي والإقليمي انطلاقا من الجدل القائم بشأنها بين المؤيدين لها والمعارضين وما استندوا إليه في تبرير مواقفهم منها، والذي انتقل إلى منظمة الأمم المتحدة التي تبنت المناهضة في إطارها سعيها لتعزيز وترقية حقوق الإنسان متبعة أسلوب التدرج من خلال التضييق من حالات الإعدام في خطوة أولى مرورا إلى مسعى الإلغاء الكلي لها عن طريق الاتفاقيات التي تنشئ التزامات للدول المصادقة عليها بإلغائها من تشريعاتها الداخلية، فكانت نموذجا سارت المناهضة على نهجه في المستوى الإقليمي. وخلصت الدراسة إلى أنه بفضل المجهودات الدولية الحثيثة في هذا المجال أصبحت عقوبة الإعدام عقوبة منبوذة من قبل المجتمع الدولي، و نتيجة لهذه الجهود كذلك تم إقرار الضمانات القانونية لتطبيق عقوبة الإعدام بالنسبة للدول التي تحتفظ بعقوبة الإعدام، ومنع عمليات الإعدام خارج نطاق القضاء أو الإعدام بإجراءات موجزة أو تعسفا.
