مكانة المحكمة الدستورية داخل المنظومة المؤسساتية في الجزائر دراسة في ظل التعديل الدستوري2020

الملخص
من بين الإصلاحات الجوهرية والمتغيرات التي جاء بها التعديل الدستوري لسنة2020، تلك التي مست مجال الرقابة على دستورية القوانين، من خلال التخلي عن المجلس الدستوري والنص على إنشاء محكمة دستورية، هذه المتغيرات أدخلت الباحثين في طرح عدة تساؤلات حول مكانة المحكمة الدستورية داخل المنظومة المؤسساتية في الجزائر، وهل إضفاء مفهوم المحكمة على القضاء الدستوري الجزائري سيعطي إضافة إلزامية لهذه المؤسسة، خاصة بعد تدعيمها بشروط جديدة ترتبط بكفاءة وقدرات أعضائها، وكذا الاختصاصات الواسعة التي تحظى بها خصوصا تلك المتعلقة بالرقابة الدستورية، والجديدة المتعلقة بالبت في الخلافات بين السلطات الدستورية وتفسير الدستور. Among the fundamental reforms and changes brought about by the constitutional amendment of 2020, those which affected the field of the oversight of the constitutionality of laws, by abandoning the Constitutional Council and by providing for the establishment of a constitutional court, these variables have led researchers to raise several questions about the position of the Constitutional Court in the institutional system in Algeria, and if the fact of giving the concept of court to the Algerian constitutional justice will give an obligatory complement to this institution, especially after having strengthened it with new conditions related to the competence and the capacities of its members, as well as the broad powers it enjoyed, particularly those related to constitutional oversight, and the new ones related to the settlement of disputes between constitutional authorities and the interpretation of the constitution.
