الحماية القانونية لحقوق فناني الأداء.

الملخص
إن نجاح أي مجتمع ورقيه مرتبط بالدرجة الأولى بالإبداع والفكر والتأليف والأداء، ولاستمرارية هذا النجاح لابد من توفير جملة من الشروط المحفزة وعلى رأسها توفير البيئة المناسبة والمناخ المساعد على الابداع وكذلك توفير الحماية القوية والفعالة لحقوق لأصحاب هذه الإبداعات ، ولا يمكن توفير هذه الشروط إلا باستحداث أنسب القوانين وأوفرها صرامة وتنظيما ودقة. وحقوق فناني الأداء تعتبر من الحقوق التي تكفلها التشريعات والاتفاقيات الدولية كغيرها من باقي الحقوق الأخرى المرتبطة بالملكية الأدبية والفنية ، وعلى الرغم من أن هذه الحقوق لا ترقى إلى درجة حقوق المؤلف إلا أن التطور التكنولوجي الحديث أبرزها بشكل ملحوظ، الأمر الذي استدعى ضرورة توفير حماية قانونيه لها، وهذا ما تم بالفعل عندما منح لفناني الأداء حماية قانونية مساوية للحماية التي منحها لحقوق المؤلفين سواء من حيث الحماية الجزائية أو الحماية المدنية بشقيها الإجرائية أوالنهائية فالتشريعات سعت جاهدة لتكييف نظام حقوق فناني الأداء مع متطلبات مجتمع المعلومات، أي الأخذ بالاعتبار ظهور التقنيات الحديثة، وتوفير المتطلبات الأساسية لتطبيق حماية أكثر فعالية لحق الفنان المؤدي. The success of any paper society is primarily linked to creativity, thought, authorship and performance, and for the continuity of this success, a number of stimulating conditions must be provided, on top of which is the provision of the appropriate environment and environment conducive to creativity, as well as providing strong and effective protection for the rights of the owners of these creations, and these conditions can only be provided by introducing the most appropriate The laws are the most stringent, organized and accurate. The rights of performers are considered among the rights guaranteed by international legislation and conventions like other rights related to literary and artistic property, and although these rights do not rise to the level of copyright, the modern technological development has highlighted them significantly, which necessitates the need to provide legal protection for them. This is what was actually done when the performers were granted legal protection equal to the protection granted to the rights of authors, whether in terms of penal protection or civil protection, both procedural and definitive. Legislation has strived to adapt the performers' rights system to the requirements of the information society, ie taking into consideration the emergence of modern technologies, and providing the basic requirements for implementing more effective protection of the performing artist's right.
