اتفاقية ضبط وإدارة مياه الصابورة (bwm /2004) ومصلحة الجزائر في المصادقة عليها

الملخص

تحمل أي سفينة في صابورتها كمية من المياه للمحافظة على توازنها، بحيث تخضع العمليات المتعلقة بمياه الصابورة لأحكام قانونية تتعلق بقواعد التوازن وبحماية البيئة والكائنات البحرية، ذلك أن عدم احترام خطوط الشحن يهدد سلامة الأرواح في البحار، كما أن الإفراغ العشوائي لمياه الصابورة يضر بالأنظمة البيئية بفعل الغزو الإحيائي الناجم عن تنقل الكائنات الحية الضارة إلى غير أماكنها الطبيعية، وتلويث البيئة البحرية ببقايا الزيوت والمواد الخطرة العالقة بجدران الصابورة. ساهمت المنظمة البحرية الدولية (OMI) في إبرام الاتفاقية الدولية لضبط وإدارة مياه الصابورة والرواسب في السفن لسنة (BWM Convention 2004) والتي دخلت حيز التنفيذ سنة 2017، كما اصدرت مدونات إرشادية تساعد في التطبيق السليم لأحكام الاتفاقية بالإضافة إلى حث التشريعات الداخلية على معالجة المشاكل المتعلقة بإفراغ مياه الصابورة والتزود بها. يستعرض المقال الموالي أحكام ضبط وإدارة مياه صابورات السفن وفق ما تقضي به اتفاقية (BWM)، ويتطرق إلى موقف المشرع الجزائري منها والاستعدادات التشريعية الوطنية المفترض اتخاذها، حيث لاحظ الباحث أن اتفاقية (BWM) تفرض على الدول التزامات فنية وتقنية تختلف آثارها الاقتصادية على الدول بالسلب أو الإيجاب بحسب إهمالها أو الاستفادة منها، كما أن هذه المتطلبات تعتبر بمثابة القواعد السارية التي لا تحتاج إلى موافقة صريحة من الدول نظرا لدخولها تحت الالتزام العام بحماية البيئة والسلامة البحرية، وهو ما جعل الباحث يدعو إلى ضرورة المبادرة بالانضمام للاتفاقية مع الاستعداد التشريعي والمادي للالتزام بأحكامها واستغلال المزايا الاقتصادية التي يتيحها الاستثمار البيئي في مجال ضبط وإدارة مياه صابورات السفن Any ship carries in its ballast a quantity of water to maintain its balance, so that operations related to ballast water are subject to legal provisions related to the rules of balance and the protection of the environment and marine organisms, As the lack of respect for shipping lines threatens the safety of life at sea, and the indiscriminate emptying of ballast water harms environmental systems due to the biological invasion caused by the movement of harmful organisms to other than their natural places, and polluting the marine environment with remnants of oils and hazardous substances stuck to the ballast walls. The International Maritime Organization (OMI) contributed to the conclusion of the International Convention on the Control and Management of Ballast Water and Sediment in Ships for the year (BWM Convention 2004), which entered into force in 2017,it also issued guiding codes that assist in the proper implementation of the provisions of the agreement, in addition to urging internal legislation to address problems related to the emptying and supply of ballast water. The following article reviews the provisions for controlling and managing ships' ballast water in accordance with the provisions of the BWM Convention, and deals with the position of the Algerian legislator regarding it and the national legislative preparations that are supposed to be taken. The researcher noted that the (BWM) agreement imposes technical and technical obligations on countries whose economic effects on countries vary, negatively or positively, according to their neglect or benefit from them, also, these requirements are considered as applicable rules that do not require the explicit consent of states due to their entry under the general obligation to protect the environment and maritime safety, This made the researcher call for the necessity of acceding to the agreement with the legislative and material readiness to abide by its provisions and to exploit the economic advantages offered by environmental investment in the field of controlling and managing ships’ ballast water
