الملخص
تهدف هذه الورقة البحثية المعنونة بــــــــــــ « عوارض أهل الأعذار وأحكامها عند المالكية دراسة فقهية وفق القانون الجزائري» إلى إبراز عظمة التشريع الإسلامي ومدى مراعاته لظروف الناس وأحوالهم، إذ قد يحصل للمكلف ما يمنعه من الإتيان بالواجبات الشرعية على وجهها الكامل، لذلك نجد أن الشريعة الإسلامية قد خففت عنه رفعا للمشقة والحرج الذي قد يلحقه، وهذا ما يبرر وجود فقه خاص يراعي هذه الظروف والذي يطلق عليه فقه أهل الأعذار. وقد حاولنا في هذه الورقة جمع ما تناثر من مسائل أهل الأعذار المتعلقة بباب إزالة النجاسة؛ وباب الطهارة، على أن يتم التطرق إلى ما تناثر من مسائل وأحكام أهل الأعذار في بقية الأبواب ضمن أوراق بحثية أخرى. The aim of this research paper is related to “The Jurisprudence of the People of Excuses in the Chapter of Lifting Impurity” And the chapter on purity according to the Maliki's. ” To highlight the greatness of Islamic legislation and the extent to which it respects the circumstances the people and their condition, as it may happen to the taxpayer something that prevents him from performing the legitimate duties in the face of it, Therefore, we find that the Islamic Sharia has relieved him of the hardship and embarrassment that may be caused. This justifies the existence of a special jurisprudence that takes into account these conditions; It is called the jurisprudence of the people In this paper, I have tried to collect the scattered issues of those who have excuses related to the chapter on removing impurity And the door of purity, Provided that the scattered issues and rulings of the people of excuses are addressed in the remaining chapters within other Research Papers.
