التعاقد في إطار نظام التأمين التكافلي

الملخص
يتناول هذا البحث موضوع التأمين التكافلي، باعتباره نظام يقوم على أسلوب تعاقدي قرر كبديل شرعي للتأمين التقليدي، وله دور هام خاصة في المجال الاقتصادي والاجتماعي، بحيث يسعى لتقديم خدمات وفقا لمبادئ الشريعة الإسلامية، ويرتكز أساسا على التعاون والتكافل بين الأفراد. وقد عرف هذا التأمين تطورات هامة في الدول التي تعمل به بما فيها الجزائر، وعلى هذا الأساس فإن هذه الدراسة ترتكز على تبيان مختلف جوانب التأمين التكافلي كنظام وكعقد من خلال تعريفه وتحديد أنواعه ثم تبيان الإطار القانوني لهذا العقد، بتحديد أركانه ومختلف إجراءاته، ثم تبيان الخصائص والمبادئ التي يقوم عليها هذا العقد، والتي تميزه عن غيره من عقود التأمين التقليدية. This research deals with Takaful also called Islamic insurance that is considered as a system relying on a cooperative (system) method. It is established as a compliant alternative to the conventional insurance, and it plays an important role, especially in the economic and social domains/ fields. It aims at providing services according to the sharia (Islamic laws) principles. Takaful system of insurance is mainly based on mutual cooperation and assistance between groups of participants. In other words, it is the provision of shared contributions to help those who are in need. Moreover, this insurance witnessed important developments in the countries of the world that us it, such as Algeria. This study focuses on displaying the different aspects of Takaful insurance as a system and as a contract by defining it and determining its different type. In addition to this research shows the legal frame work of this contract by determining its components and its different procedures. It also demonstrates the characteristics and tenets of this insurance and what differentiates it from other conventional insurances.
