المجلس الدستوري الموريتاني والرقابة على الانتخابات

الملخص
يهدف هذا البحث إلى دراسة دور المجلس الدستوري الموريتاني في الانتخابات لمعرفة مستوى الرقابة التي يقوم بها في ظل وجود اللجنة المستقلة للانتخابات، والدور الرقابي التي تمارسه المحكمة العليا في بعض النزاعات الانتخابية. وقد خلصت الدراسة إلى أنّ المجلس الدستوري، يمثل قاضي الانتخابات البرلمانية والرئاسية، لكنه يهيمن على الانتخابات الرئاسية بشكل كامل، بينما يتدخل في الانتخابات البرلمانية للبت في النزاعات بشأنها. إنّ هذا البحث يمثل إضافة في موضوعه، إذ يتعلق بدور المجلس الدستوري في الانتخابات التي تتوقف عليها عملية الانتقال الديمقراطي والتداول السلمي على السلطة. Abstract This research aims to study the role of the Mauritanian Constitutional Council in the elections to know the level of oversight that it performs in the presence of the Independent Elections Committee, and the oversight role exercised by the Supreme Court in some electoral disputes. The study concluded that the Constitutional Council represents the judge of the parliamentary and presidential elections, but it dominates the presidential elections completely, while interfering in the parliamentary elections to decide disputes about them. This research is an addition to its topic, as it relates to the role of the Constitutional Council in the elections on which the process of democratic transition and the peaceful transfer of power depends.
