جرائم الشركات التجارية

الملخص

تكريس المسؤولية الجزائية للشركات التجارية إحدى أهم أدوات الاستقرار الاجتماعي و الاقتصادي لمواجهة الجرائم المرتكبة من قبلها باستعمال هيئات إدارتها و ممثليها, فشملت الكثير من الجرائم منها الجرائم المنصوص عليها في قانون العقوبات لاسيما الجنايات و الجنح الواقعة ضد امن الدولة و النظام العمومي و مساعدة المجرمين، جرائم الواقعة ضد الأشخاص و الأموال، أيضا جرائم تكوين جمعيات الأشرار جرائم التزوير و جرائم الغش في بيع السلع و التدليس في المواد الغذائية و الطبية. كما وردت بعض الجرائم المنصوص عليها صراحة أو ضمنيا بموجب قوانين خاصة ولتوضيح ذلك تناولنا جرائم الصرف،جرائم المخدرات و المؤثرات العقلية، جرائم التهريب، الفساد، و جرائم حظر استخدام الأسلحة الكيميائية. و في مقابل ذلك يوجد بعض النصوص التي أخذت ضمنيا بالمسؤولية الجزائية للشخص المعنوي الذي يرتكب الممارسات المقيدة للمنافسة و ذلك بتسليط عليه الجزاءات المالية. سنحاول من خلال هذه المساهمة المتواضعة تسليط الضوء على الجرائم المرتكبة من قبل الشركات و التي تترتب عليها المسؤولية الجزائية. Devoting criminal responsibility to commercial companies is one of the most, important tools for social and economic stability to confront the crimes committed by them, through the use of their management bodies and representatives. It included many crimes, including crimes stipulated in the penal code, especially felonies and misdemeanors against state security, the public system and assistance to criminals. Crime against people and money as well as crimes of forming association of bad guys crimes of forgery and crimes of fraud in the sale of goods and fraud in food and medical materials. Some crimes stipulated explicity or implicitly under special laws. To illustrate this, we dealt with exchange crimes of narcotic drugs and psychotropic substance smuggling crimes corruption and crimes prohibiting the use of chemical weapons. In contrast, there are some provisions that have implicitly taken into account the criminal liability of the legal person who commits anti competitive practices by imposing financial sanctions. Through this modest contribution, we will try to highlight the crimes committed by companies that entail criminal liability
