تسوية الصعوبات المالية للشركات التجارية: دراسة في أحكام القانون التجاري و قانون المالية

الملخص
تعترض الشركات التجارية عدة صعوبات تختلف حسب مجالات نشاطها و الظروف المحيطة بها، فنجد صعوبات ذات طبيعة إدارية، قانونية، اجتماعية، اقتصادية و مالية؛ هذه الأخيرة قد تؤدي إلى اختلال وضعية الشركة و تعثرها، امكانية افلاسها و زوالها من الحياة التجارية. من أجل تفادي ذلك، يقر القانون الجزائري عدة تدابير و إجراءات، سواء بموجب أحكام القانون التجاري أو بموجب أحكام قانون المالية. تنصب علــى معالجة الصعـــوبات المالية للشركات التجــارية، بشكل يسمـــح لها بتخطي هذه الصعوبــات، و استعادة وضعيتها الاقتصادية السليمة. Abstract: Commercial companies encounter several difficulties that differ according to their areas of activity and the circumstances in which they are involved. We find difficulties of an administrative, legal, social, economic and financial nature, the latter of which may lead to disruption of the company’s position, its stumbling, the possibility of its bankruptcy and its demise from commercial life. In order to avoid this, Algerian law approves several measures and procedures, whether under the provisions of the commercial code or under the provisions of the finance law, focused on addressing the financial difficulties of commercial companies, in a way that allows them to overcome these difficulties, and restore their sound economic position.
