الملخص

إن المآل أصل يحكم بمقتضاه الحاضر باعتبار ما سيكون عليه في المستقبل،واعتبار المآل إنما هو في حقيقته اعتبار لمقاصد الشرع الراعية للمصالح حالا واستقبالا، فنستشف من هذا العلاقة الوطيدة بين المقاصد الشرعية التي يراعيها الفقيه عند الاجتهاد و المآل الذي سيكون عليه الحكم،وهذا ما يتجلى في مسألة الفحص الطبي قبل الزواج حيث كان لاعتبار البعد المقاصدي باعتبار ما سيؤول عليه الحكم - وذلك من خلال عرض واستقراء الايجابيات والسلبيات للهذه الوسيلة - دور بين في استخراج الحكم الراجح لهذه المسألة من طرف ثلة من مجتهدي هذا العصر.The fate is an asset whereby the present is judged as what it will be in the future, so we can see from this close relationship between the legitimate purposes that the jurist takes into account in the jurisprudence and the fate of the judgment that will be taken into account by the hardworking, the ruling considers the fate as an important element in the process of contemporary jurisprudence and the developments and currents that have taken place, and this is through the realization of a future view of the benefit that will be achieved or otherwise, as reflected in the issue of examination. Medical before purposes through the implementation of this rule by a group of hard-working people of this era.
