تفويض المرفق العام

الملخص
يشكل تفويض المرفق العام أحد الأساليب الحديثة في تسيير المرافق العامة التي إعتمدتها الدولة الجزائرية بعد الأزمة التي عرفها المرفق العاموالتي أفرزت عجز الدولة عن تسيير مختلف المرافق العمومية ، وتهدف الدراسة إلى تحقيق مجموعة من الأهداف تتمثل في معرفة الجانب التشريعي والتطبيقي لتسيير المرفق العام والإلمام بها ، ومعرفة الإيجابيات والسلبيات في غدار العلاقة المركبة لعملية التفويض وكذا تهدف إلى المساهمة في الوصول إالى نتائج من شأنها العمل على تطوير تسيير المرافق العمومية في إطار قانوني منظم . ومن ضمن النتائج المتوصل إليها هي : صعوبة وضع تعريف شامل مانع لتفويض المرافق العامة وهذا راجع لغختلاف المرافق وتطورها وتغيرها بإستمرار ، وحينما تتصرف الإدارة عن طريق الإتفاق تكون في مركز أقوى مع المتعاقد معها ، وكذا صعوبة فهم القانون الواجب التطبيق هل هو القانون الاإداري ام القانون المدني . الكلمات المفتاحية : المرفق العام ، التفويض ، التسيير ، العقد الإداري ، الإمتياز Summary Delegating the public utility is one of the modern methods of managing public utilities adopted by the Algerian state after the crisis in the public utility, which resulted in the state’s inability to run the various public utilities. The positives and negatives in the betrayal of the complex relationship of the delegation process, as well as aiming to contribute to reaching results that will work on developing the management of public utilities within an organized legal framework. Among the results reached are: the difficulty of developing a comprehensive definition that prevents the delegation of public utilities, and this is due to the different facilities, their development and change constantly, and when the administration acts by agreement, it is in a stronger position with the contractor, as well as the difficulty of understanding the applicable law, is it the administrative law or the civil law .
