الآليات القانونية للبيع القضائي للعقار Legal Mechanisms For The Judicial Sale Of Real Estate

الملخص
ان للعقار قيمة واهمية اقتصادية واجتماعية في المجتمع، لذا فان المشرع الجزائري ووفقا لما جاء في قانون الاجراءات المدنية والإدارية ؤقم: 08-09 قد وضع قواعد اجرائية دقيقة، اذ ان الهدف من ذلك عدم التسرع في بيع العقار حتى لا يحرم المدين او صاحب العقار من ملكية عقاره، وذلك من خلال اعطائه المهلة الكافية لتسديد الدين بدلا من بيع عقاره المحجوز، وتعد القواعد الاجرائية المنظمة للحجز العقاري قواعد آمرة لا يجوز للدائن الحاجز مخالفتها. The real Estate has an economic and social‘s value and an importance in society, so, the Algerian Legislator and in according to the civil and administrative procedures law, 08/09 had established a specific Procedural rules, aim to get slowly for not selling the property, to protect the debtor and the owner of property, that’s by, giving him the adequate deadline to pay off the debt, instead of selling his reserved property, and those procedural rules which organize the booking estate, are considered as an peremptory , the creditor barrier cannot be violated it.
