الإطار الإصلاحي لصنـاعة وفـعّــالـيــة الــدائــرة الإنـتــخــابــية التـمـثــيلية

الملخص
ضمن الأطر الإصلاحية، بعد تعديل الدستوري الجزائري لعام 2020م تثير الدائرة الإنتخابية للباحث تجاذبات قانونية حول أحقية الجهات المختصة بصناعتها بين السلطتين التنفيذية، والتشريعية، مع رجحان كفة صناعة الدائرة الإنتخابية للسلطة التنفيذية؛ نهدف من هذا الموضوع إلى إبراز فعالية الدائرة الإنتخابية لما له من أهمية ذاتية تتعلق بجهة، وطريقة صناعتها، وتجسيدها الميداني. وأهمية موضوعية مرتبطة بسبب، والغاية من جودها. وبالنتيجة يعمّق الإطار الإصلاحي لآلية الدائرة الإنتخابية دفعة نوعية، لأجل إضفاء روح الفعّالية المنشودة للمنظومة الإنتخابية، ودعامة النزاهة، والشفافية. الأمر الذي يؤثر حتما على حقيقة التمثيل، وبالتالي تكرس مبدأ المصداقية، ومنه شرعنة العمل المؤسساتي على أساس دستوري، وقانوني فعّال. Enter your abstract here Within the reform framework, following the amendment of the Algerian Constitution of 2020, the electoral district of the researcher raises legal arguments about the entitlement of the competent authorities of its industry between the executive and the legislative branches; We aim to highlight the effectiveness of the electoral district because of its subjective importance, the way it is made and its on-the-ground embodiment. An objective significance is linked to the reason and purpose of its existence. As a result, the reform framework for the constituency's machinery deepens a qualitative boost in order to give the electoral system the desired effectiveness, integrity and transparency. This inevitably affects the reality of representation, thereby establishing the principle of credibility, including the legitimacy of institutional action on a constitutional and effective legal basis.
