الحجر القانوني: إجراءاته وإشكالاته

الملخص
يعد موضوع الحجر القضائي من الموضوعات العملية المهمة، نظرا لتعلقه بأهلية الأشخاص، إذ يرتبط بفئة هامة من فئات المجتمع، وهي فئة القصر والمحجور عليهم. إنه يرتبط من الناحية الاجتماعية بتوفير الرعاية لهم، كما أنه شديد الارتباط بتعاملاتهم المالية، فهو يحد من أهليتهم ويمنعهم من التصرف في أموالهم. ويثير الحجر العديد من الإشكالات في الجانب العملي بسبب قلة النصوص القانونية المنظمة لإجراءاته في القانون الجزائري، مما أفرز ثغرات لا بد أن تسد، كما أن التناقضات الموجودة بين بعض نصوصه، أصبحت ترهق كاهل المتقاضين وتحول دون تحقيق الغايات التي وجدت لأجلها. هذا المقال يسعى، من خلال تناول مفهوم الحجر وأسبابه وعرض إجراءاته، إلى رصد إشكالاته واقتراح بعض الحلول. Abstract: The subject of Judi cial interdiction is an important paractical issue, given its relation to the iligibility of people, as it is linked to an important category of society, namely the category of minors and those interdicted. It is socially related to providing care for theim, and it is closely related to their financial dealings as it limits their eligibility and prevents them from disposing of their money. It also raises many problems on the practical side due to the lack of legal teats regulating its procedures in Algerian low, which has resulted in gaps that must be filled, and the contradictions between some of its teats have be come burdeusome to litigants and prevent the achievement of the goals fos wich i twas found. By addressing the concept of quarantine its causes and procedures, this article seeks to monitor its problems and suggests some solutions.
