الملخص
الملخص باللغة العربية: اعتنى الإسلام بالجانب الوقائي في كثير من القضايا الاجتماعية، لأنّه أنجع و أفضل سبيل، ومن المقرّر أنّ الوقاية خيرٌ من العلاج، و قد جاء هذا البحث بهدف إبراز السّبل و الطّرق التي شرعها الإسلام لتجنّب الطّلاق، و الخلع، إذ دلّتْ نصوص القرآن الكريم والسنّة النّبوية المطّهرة أنّ من مقاصد الزّواج في الإسلام هو الديمومة والاستمرار، و حفظ العرض و النّسل. وللمحافظة على هذا المقصد، ولقطعِ الطُّرق التّي تعترضه، وحمايةِ الرّابطة الزّوجية من أيّ تصدّع أو انهيار، شرعَ الإسلام أحكاما قبل الزّواج كحسن الاختيار و الرّؤية، وشرع أحكاماً بعده؛ تتمثّل في بيان واجبات الزّوجين لضمان حقوق كلٍّ واحد منهما، ولتحسين العلاقة و الوضع في الأسرة، كما شرع أحكاماً لإصلاح النّزاع، والخلاف بين الزّوجين في حال وقوعه. Abstract Islam has taken care of the prevention in many social issues, because it is the best way.This research aimsto highlight the means that Islam legislated to avoid divorce and khul’, as the texts of the Holy Qur’an and the Sunnah indicate that one of the purposes of marriage in Islam is permanence, and the preservation of honor and offspring.To preserve this goal, and to protect the marital bond from collapse, Islam legislated rulings before marriage such as good choice and the vision, and rulings after it; It is represented in clarifying the duties of the spouses toguarantee the rights of each one of them, and to improve the relationship and the situation in the family.It also legislated rulings to solve the dispute, between the spouses if it occurred.
