دور المحكمة الدستورية في تفسير القاعدة الدستورية في ظل التعديل الدستوري 2020

الملخص
أفضى التعديل الدستوري لسنة 2020 إنشاء المحكمة الدستورية كمؤسسة مستقلة مكلفة بضمان احترام الدستور, خطوة إيجابية خطاها المؤسس الدستوري حماية للحقوق والحريات المكفولة دستوريا وإرساء لمبدأ سمو الدستور في مواجهة الترسانة القانونية داخل الدولة وما تقدم عليه السلطات والمؤسسات ذوات الحكم والصلاحيات من تغول, يضاف لصلاحيات المحكمة الدستورية إلى جانب الرقابة على دستورية القوانين والسهر على التطبيق السليم للدستور أن يكون لها نصيب الأسد في تفسير القواعد الدستورية أصالة لا تبعية تجاوزا للفراغ الذي ساد تعاقب الدساتير الجزائرية السابقة, لكن يبقى التساؤل مطروحا حول فعالية ممارسة المحكمة الدستورية التفسير بصورة حقيقية في ظل أن التفسير يرتبط بالإخطار ارتباط السبب بالنتيجة هذا التضارب يعكس قصور المحكمة الدستورية في تحقيق دورها بصورة أنجع . The constitutional amendment of 2020 led to the establishment of the constitutional court as an independent institution charged with ensuring respect for the constitution, a positive step taken by the constitutional founder to protect constitutionally guaranteed right and freedoms and to establish the principle of the supremacy of the constitution in the face of the legal arsenal within the state and what the authorities and institutions with governance offer in addition to the powers of the constitution court in addition to controlling the constitutionality of laws and ensuring the proper application of the constitution it should have the lion’s share in the interpretation of constitutional rules authenticity not subordination bypassing the vacuum that prevailed In the succession of previous Algerian constitution indeed in light of the fact that the interpretation is linked to the notification the link between cause and effect this inconsistency reflects shortcomings of the constitutional court in achieving its role more effectively
