آثار الكفالة في قانون الأسرة الجزائري

الملخص
ملخص: يترتب على عقد كفالة الطفل العديد من الآثار القانونية. بالنسبة للكافل، إذ يلتزم بعدم تلق أجر مقابل الكفالة، كما يلتزم بالإنفاق على المكفول، ويلتزم أيضا بالتربية والرعاية، وإدارة أموال القاصر. وللكافل الحق في قبض المنح العائلية والدراسية للمكفول، كما له الحق في الإيصاء والتبرع للقاصر المكفول، والحق في منح لقبه العائلي للمكفول. كما يترتب عنها آثار بالنسبة للمكفول، حيث يحتفظ بلقبه الأصلي، ولا تثبت له حرمة المصاهرة، ولا الميراث. كما أن للكفالة آثار بالنسبة لأبوي المكفول، إذ يلتزم الكافل لهما بتسليم المكفول، كما من آثارها سقوط الولاية عن أبوي المكفول، ويبقى لهما حق الزيارة. ونهدف من هذا البحث إلى بيان آثار الكفالة، ومدى صيانتها لحقوقه ونحقيق مصلحته في ظل قانون الأسرة الجزائري، ونصل إلى نتيجة أن المشرع أقر جملة من الآثار القانونية المترتبة على إبرام الكفالة وذلك من خلال التزام الكافل بالقيام بالقاصر قيام الأب بابنه، مع تحريم التبني. Abstract: The child sponsorship contract has many legal implications. As for the sponsor, he is obligated not to receive remuneration in exchange for sponsorship, he is also obligated to spend on the sponsored, and he is also committed to education, care, and management of the minor’s money. The sponsor has the right to receive family and study grants for the sponsored, as well as the right to bequeath and donate to the sponsored minor, and the right to grant his family title to the sponsored. It also has implications for the sponsored person, as he keeps his original title, and neither the sanctity of intermarriage nor the inheritance is proven for him. The sponsorship also has effects for the parents of the sponsored person, as the guarantor is obligated to them to hand over the sponsored, and one of its effects is the fall of guardianship from the parents of the sponsored person, and they retain the right of visitation. We aim from this research to clarify the effects of sponsorship, and the extent of its maintenance of his rights and the achievement of his interest under the Algerian family law, and we come to the conclusion that the legislator approved a number of legal effects resulting from the conclusion of sponsorship, through the commitment of the sponsor to carry out the minor to the father and his son, with the prohibition of adoption.
