التأمين من المسؤولية المدنية عن حوادث البناء

الملخص
خص المشرع الجزائري حيزا من القوانين لموضوع المسؤولية عن حوادث البناء، وشدد على مقاول البناء والمهندس المعماري على تأمينها نظرا للخطورة الأضرار التي قد تنجر عن تهدم البناءات ولتعلق المباني بالمصلحة العامة، فالهدف من هده الدراسة يتمثل في تحديد المسؤوليات التي يتعرض لها كل من مقاول البناء والمهندس المعماري وفقا للقوانين المعمول بها، وكذا أحكامها التي يستند عليها المضرور في المطالبة بحقوقه. ومن أهم نتائج المتوصل إليها من خلال هذه الدراسة يتجلى في كون التأمين عن المسؤولية المدنية عن حوادث البناء الآلية الأساسية التي تخرج المؤمن له من أزمته في حالة وقوع الخطر وإعادته إلى وضعه الذي كان عليه من قبل.
