الملخص
ملخص: إن الدساتير الجزائرية اهتمت بحرية الإبداع والابتكار والاعتراف بحقوق الفكرية على أساس أنها حقوق تستمد سندها من الحماية الدولية للحقوق الثقافية للإنسان. إن الدستور يشكل المرجعية الأساسية لكل أمة ويحدد المبادئ والقواعد الأساسية التي ينبغي مراعاتها وعدم مخالفتها، وعلى هذا الأساس فدسترة حقوق الملكية الفكرية وإدراج ضوابط تحكمها تعد خطوة إيجابية نحو تقوية هذه الحقوق وتنميتها ويضمن لها لا محالة حماية فعالة وناجحة. Abstract : The Algerian constitutions are concerned with freedom of creativity and innovation, and the recognition of intellectual property rights on the basis that they are rights that derive their basis from the international protection of human cultural rights. The constitution constitutes the basic reference for every nation and defines the basic principles and rules that must be observed and not violated. The constitutionality of intellectual property rights and the introduction of regulations governing them is a positive step toward strengthening and developing these rights, and inevitably guarantees them effective and efficient protection.
