مدى إمكانية إخضاع العناقيد الصناعية لرقابة مجلس المنافسة

الملخص
ملخص: تعتبر العناقيد الصناعية أحد الوسائل االهمة لرفع فعالية المؤسسات وزيادة تنافسيتها في السوق، ونظرا لتوافق سياسة العناقيد الصناعية مع أسس التجميعات الاقتصادية ، فإن هذه الأخيرة تخضع لرقابة مجلس المنافسة في حالة ما إذا كانت تشكل مساسا بالمنافسة ، وعلى هذا حتى يمكن القول بإمكانية إخضاع العناقيد الصناعية لرقابة مجلس المنافسة لابد من توفر شروط والتي أهمها : أن يتخذ العنقود الصناعي شكل تجميع اقتصادي وأن يمس بالمنافسة داخل السوق من خلال تحقيق حصة سوقية حددها المشرع في قانون المنافسة . Abstract : Industrial clusters are one of the effective means to raise the effectiveness of institutions and increase their competitiveness in the market ,in view of the compatibility of the policy of industrial clusters with the foundations of economic groupings the latter is subject to the control of the competition council in the event that it constitutes a prejudice to competition accordingly, in order for it to be said that the industrial clusters can be subjected to the control of the competition council, conditions must be met the most important of which is that the industrial cluster take the form of an economic cluster and to be prejudicial to competition hence within the market by achieving a market share specified by the legislator in the competition law. Résumé : Les clusters industrielles sont considérées comme l’un des moyens importants d’augmenter l’efficacité des entreprises et d’augmenter leur compétitivté sur le marché, compte tenu de la conformité de la politique des clusters industriels avec les fondements des groupements économiques, ces derniers sont soumis au contrôle du Conseil de la concurrence dans le cas où ils constituent un préjudice à la concurrence, ainsi ,pour pouvoir dire que les clusters industriels peuvent être soumis au contrôle du Conseil de la concurrence, des conditions doivent être réunies, dans la plus importante est que le cluster industriel prenne la forme d’un groupement économique et effecte la concurrence au sein de le marché en obtenant une part de marché spécifiée par le législateur dans le droit de la concurrence .
