الوسائل الشرعية لإصلاح الجاني وإعادة إدماجه اجتماعيا

الملخص
لم یكن قصد الشريعة الإسلامية بترتيب مختلف العقوبات الدنيوية على الجناة إتلافهم أو إهلاكهم، وإنما كان قصدها تأديبهم وتهذيبهم، وتقويمهم لإخراجهم من أوحال الفساد، وإعادة إدماجهم في المجتمع كأعضاء مصلحين – بله- صالحين، وتوسلت للوصول إلى ذلك بجملة من الوسائل التي منها ما یكون حال امتثال العقوبة ومنها ما یكون بعد ذلك، وقد أسفر البحث عن أهم هاتیك الوسائل، فمنها: معالجة السجين صحيا، وتعليمه العلم النافع، وتكوينه وتعليمه طرق الكسب الحلال، ومنها رعاية السجين ماديا عند الإفراج عنه، ورعايته اجتماعيا بعد الإفراج عنه Abstract: It was not the intention of the Islamic sharia to arrange the various worldly punishments for the perpetrators of the destruction, but it was intended to discipline them and rehabilitate them to remove them from corruption, and reintegrate them into society as reforming members in a good way and sought to reach this by a number of means, then, this research resulted in the most important of these means, Among them: treating the prisoner in a healthy way, teaching him useful knowledge, training him and teaching him the methods of lawful earnings, including taking care of the prisoner financially upon his release, and caring for him socially after his release.
