Revisiting Resolution 181 About The Partition Plan For Palestine

Abstract
Abstract This paper seeks to revisit the decision of the partition plan of Palestine, it restudies resolution 181 by going back especially to the works of the United nations special committee on Palestine (UNSCOP) which prepared several reports studying the history and circumstances of the conflict and the several solutions that were proposed by the different acting parties. The paper tries to identify the arguments that were laid out by the committee in the reports whether they are legal, political or even biblical in order assess the final outcome and be able to judge if such a plan could be considered as a failure of international law or not. Keywords: Palestine; partition plan; UNSCOP; international law; resolution 181. ملخص: تحاول هذه الورقة تقديم إعادة قراءة للقرار الذي نتج عنه تقسيم فلسطين، وذلك بالعودة الى التوصية رقم 181 والتي تلت مجموعة من الأعمال والتقارير التي كانت قد أعدتها اللجنة الخاصة للأمم المتحدة حول فلسطين. اللجنة من خلال هذه التقارير تطرقت الى العديد من الجوانب التاريخية، السياسية والقانونية بل وحتى الدينية منها كما ناقشت العديد من مقترحات الحلول التي كانت قد قدمتها مختلف الأطراف الفاعلة آنذاك ولهذا فستحاول هذه الورقة ان تستخلص جملة الحجج و والمنطق الذي اعتمدت عليه اللجنة في اقتراحها حل التقسيم، وانطلاقا من هذه الحجج سيسعنا تقييم ما إذا كان القرار يعتبر بمثابة فشل للقانون الدولي أم لا. كلمات مفتاحية: توصية 181؛ فلسطين؛ قرار التقسيم؛ القانون الدولي.
