مسؤولية الحماية تطوير للتدخل الإنساني أم تطويع له؟

الملخص
مع تزايد نشوب النزاعات الداخلية بعد انتهاء الحرب الباردة، وكثرة الانتهاكات الجسيمة لحقوق الأفراد والجماعات برزت ظاهرة "التدخل الإنساني" كآلية للدفاع عن حقوق الإنسان وحماية الأقليات ووقف الجرائم ضد الإنسانية وتأمين وصول المساعدات الإنسانية. غير أنّ "التدخل الإنساني" لحماية حقوق الإنسان أثار العديد من الخلافات والانتقادات، حول مشروعيته، وحول الانتقائية وتغليب الاعتبارات السياسية التي تطبعه. مما دفع بالأمم المتحدة للبحث عن بديل عنه يتجاوز هذه الانتقادات، فكانت عقيدة مسؤولية الحماية. هذه الأخيرة التي تعدّ من الناحية النظرية تطويرا مهما للتدخل الإنساني لحماية حقوق الإنسان، ولكنّ التدخلات التي تمّت بموجب مسؤولية الحماية لحد الآن أثبتت من الناحية العملية أنّ هذا النهج أيضا ما يزال يعاني من معظم الانتقادات التي لازمت التدخل الإنساني، مما يؤثر على الحماية الدولية الفعّالة لحقوق الإنسان With the the increasing outbreak of internal conflicts, after the end of the cold war, and numerous grave violations of the rights of individuals and groups, the phenomenon of "humanitarian intervention" has emerged as a mechanism for defending human rights, protecting minorities, halting crimes against humanity and securing humanitarian access.
