إشكالية الأراضي العرشية وآثارها القانونية على التنمية المحلية

الملخص
يشكل موضوع أراضي العرش أحد أهم المواضيع القانونية في الساحة العقارية الجزائرية، حيث أنه كان ولا يزال مثار جدل مستمر بين الكتاب حول طبيعتها القانونية، وعن أفضل السبل نجاعة لاستغلالها دون أن يشكل ذلك سخطا شعبيا لدى أهالي العروش الذين دأبوا على استغلالها منذ قرون. كما أن منازعات هذه الأراضي تشكل العدد الأكبر على مستوى جداول المحاكم المجالس ومكاتب التوثيق وكذا لدى المصالح الإدارية التي لذا علاقة بالعقار. سنحاول من خلال هذا البحث تعريف الأراضي العرشية، ثم بيان طبيعتها القانونية وأهم الأحكام القانونية التي تخضع لها الأراضي العرشية نتيجة اختلاف طرق استغلالها. The subject of throne lands is one of the most important legal issues in the Algerian real estate arena, as it was and still is the subject of an ongoing debate among writers about its legal nature, and about the means the best and most efficient to exploit without causing popular discontent among the people of the thrones who have been exploiting them for centuries. In addition, these land disputes constitute the greatest number at the level of the tables of the courts, councils and documentation offices, as well as with the administrative services that have a connection with real estate. Through this research, we will try to define the lands of the throne, then to explain their legal nature and the most important legal provisions to which the lands of the throne are subject because of the different ways of exploiting them.
