بيع أموال القاصر في التشريع الجزائري

الملخص
لقد حضي القاصر في التشريع الجزائري و على غرار باقي التشريعات الوضعية بعناية خاصة بالنظر إلى وضعه الحساس ، حيث أنه و بسبب انعدام أو نقص أهليته، يتعذر عليه أن يباشر أموره المالية بنفسه ، مما استدعى تولية شؤونه إلى شخص أخر يحل محله في إدارة و التصرف في أمواله يسمى بالنائب الشرعي . هذا الأخير وبالرغم من الدور الكبير المنوط به ، إلا أن المشرع لم يطلق سلطته ، بل قيده بمجموعة من الضوابط القانونية التي تحكم تصرفاته ، بموجب نصوص قانون الأسرة ، وكذا قانون الإجراءات المدنية و الإدارية ولاسيما فيما يخص بيع أموال القاصر ، حيث أوجب عليه الحصول على إذن من قاضي شؤون الأسرة عند رغبته في بيع منقولات القاصر ذات الأهمية الخاصة ، بعد إثبات المبرر والمصلحة الظاهرة . أما إذا تعلق الأمر بالعقارات فلا يكفي الإذن وحده بل لابد أن يتم البيع تحت إشراف القضاء ، و ذلك من خلال إتباع إجراءات البيع بالمزاد العلني ، لأن البيع يعد من أخطر التصرفات التي تؤثر على الذمة المالية للصغير. The minor in Algerian legislation, like the rest of the man-made legislation ,has been given special care in view of his sensitive situation as due to lack or lack of capacity ,he is unable to conduct his financial affaires himself ,which necessitates taking over his affaires to another person to remplace him in managing and disposing of his money .he is called the legal representative The latter ,despite the great role entrusted to him ,but the Algerian legislator did not release his authority ,but rather restricted him with a set of legal controls that govern his actions ,according to the provisions of the family law ,as well as the civil and administrative procedures law, especially with regard to the sale of the funds of the minor entrusted to him ,as he must obtain permission from the family affaires judge when he wants to sell the minor’s movables of special importance after establishing the justification and apparent interst that calls of that as for real estate ,judicial permission alone is not sufficient rather the sale must take place under the supervision of the judiciary ,by following the procedures of selling by public auction ,because the sale is one of the most dangerous legal actions that will affect on the financial liability of the Young
