L’inclusion Du Concept Des Facilités Essentielle Dans La Loi De La Concurrence

Résumé : Le terme facilité essentielle englobe les différents éléments matériels et immatériels dont dispose une entreprise en position dominante qui sont, en effet, indispensables pour accéder au marché. On peut apprécier «l’essentialité » dans cet aspect, soit à travers la nécessité ; la facilité est indispensable pour exercer l’activité économique, soit à travers la substituabilité ; la facilité constitue l’unique moyen pour accéder au marché. Ainsi afin d’effectuer l’étude du marché pertinent, du fait qu’il constitue un élément primordial dans l’appréciation de la facilité, le caractère spécifique de cette dernière doit être confirmé et démontré. Abstract: The term "essential facility" encompasses the different tangible and intangible elements that a dominant company has at its disposal and that are indispensable for accessing the market. The essentiality of this aspect can be appreciated either through necessity or through the fact that the facility constitutes the only means of accessing the market. Thus, in order to carry out the study of the relevant market, since it constitutes a primordial element in the appreciation of the facility, the specific character of the latter must be confirmed and demonstrated
