الملخص
الملخص: تهدف الدراسة إلى تسليط الضوء على مراحل تطور النظام القانوني لتفويضات المرفق العام في الجزائر، استعملنا فيها المنهج التاريخي والتحليلي المقارن من خلال عرض التطور لأساليب التسيير لدى الإدارة، وهذا بهدف معرفة أوجه التطور والتغيير والمستجد في النظام القانوني وما مدى درجة نجاح تقنية تفويض المرفق العام في الجزائر، حيث خلصت الدراسة إلى عرض مرحلتين في تاريخ النظام القانوني لتفويضات المرفق العام، المرحلة الأولى تناولنا فيها النظام القانوني لأساليب التسيير ما قبل سنة 2015 والمرحلة الثانية تناولنا فيها النظام القانوني لتفويضات المرفق العام بعد سنة 2015 التي تعتبر بداية مرحلة جديدة في إرساء قواعد عامة وشاملة تنظم هذا النوع من العقود، وتعتبر النتائج التي توصلنا إليها في غاية الأهمية، وذالك أنّ المشرّع الجزائري قد ساير التشريعات المقارنة في هذا المجال بداية من هذه المرحلة إلا أنّ اللجوء إلى هذه العقود ضعيف نتيجة لأسباب ذكرنها في الخاتمة اقترحنا فيها توصيات Abstract: The study aims to shed light on the phases of evolution of the legal regime of public service delegations in Algeria, in which we used the comparative historical and analytical approach by presenting the evolution of management methods in the administration, with the aim to know the aspects of evolution, change and novelty in the legal regime and What is the success of the technique of delegation of public service in algeria, the study concluded by presenting two phases in the history of the legal régime for public service delegations, the first phase dealt with the legal régime for management modes before 2015 and the second phase in which we dealt with the legal regime for public service delegations after 2015, Which is considered the beginning of a new phase in establishing general and comprehensive rules regulating this type of contracts, the results we have reached are very important, this is because the algerian legislator has kept pace with the comparative legislation in this field starting from this phase, but the recourse to these contracts remains weak due to the reasons we mentioned in the conclusion, in which we proposed recommendations
