الملخص
تهدف هذه الدراسة إلى معالجة حالات المسؤولية التضامنية في شركة المساهمة، التي تشكل استثناء من مبدأ تحديد المسؤولية الذي تقوم عليه شركة المساهمة. وفق منهج تحليلي نقدي للنصوص القانونية الناظمة لأحكام شركة المساهمة. وقد خلص الدراسة إلى أنه رغم سعي المشرع الجزائري إلى وضع قواعد خاصة لهذه المسؤولية حماية للغير وللشركاء، وبصفة عامة حماية للادخار العام، إلا أن هذا المسعى يحتاج إلى مزيد من المراجعات. Abstract: This study aims to examine the cases of joint liability in the joint-stock company, which constitute an exception to the principle of determining liability upon which the joint-stock company is based. According to a critical analytical approach to the legal texts regulating the provisions of the joint stock company. The study concluded that despite the Algerian legislator’s endeavor to establish special rules for this responsibility to protect others and partners and in general to protect public savings, this endeavor needs further revisions
