الملخص
ملخص بالعربية: أصبح للبحث في مستقبل آليات تنفيذ القانون الدولي الإنساني ما يبرره من نواحي متعددة فعودة النظام الدولي إلى الحالة من الارتداد إلى القرون السابقة والإلحاح على استخدام القوة لأجل تنفيذ أحكام القانون الدولي الإنساني لا يعكس أبدًا مساحة الخيرية في السلوك الإنساني أثناء النزاع المسلح، إضافة إلى أن المعادلة التي يقبل عليها العالم لا تؤمن بالتوازن الدولي ولا تبشر بقرب التوصل إلى إجماع دولي حول تطبيق القانون الدولي الإنساني دون معيارية ولا الكيل بمكيالين فانعدام التوافق مثلا حول موضوع المحكمة الجنائية الدولية يعكس هذا الخلاف الدولي ولأجل ذلك كان لاستعمال الوسائل الاقتصادية والتدخل الإنساني لتنفيذ أحكام القانون الدولي نقمة على المجتمع الدولي أكبر منها نعمة في العلاقات الدولية إذ عوض أن تأتي لتخفيف أثار الحرب على البشرية جاءت على عكس ذلك بمآسي كأنها مشروعة الأمر الذي يؤكد أن واقع الآليات المستعملة لتنفيذ قواعد القانون الدولي من قبل مجلس الأمن لها من النقائص والسلبيات دافعا إلى مراجعتها منتظرين الدور الإيجابي لمجلس الأمن ومختلف هيئات الأمم المتحدة. الكلمات المفتاحية: ( الإنساني-تنفيذ-آليات-واقع-آفاق ) Abstract: Implementation mechanisms of to international humanitarian Law: realities and Perspective Looking for new and more efficient mechanisms to implement the international humanitarian Law has become legilimate and necessary, Due to the world order state in different fields. It sums obvious a retrogradation to a state similar to that of the previous centuries when using force to implement legal provisions of the humanitarian international Law, was prevailing. That doesn’t refleet the large space of charity in the behaviours of man during armed conflicts. In additions the upcoming equation of the world doesn’t belive I, any international balance neither it foresees a close international consensus over implementing a double-standard-free International Law. The absence of an agreement, for instance, over the international criminal court shows how deep is the international controversy. For this, we consider using economic instruments and humanitarian interventions to apply legal provisions, a scourage rather than a favour for the international community. They caused more misery instead of bringing relief to people after the effect of war. All in all we are quite sure that the reality of the present mechanisms of implementing the norms of the humanitarian international Law used by the security conncil have many negative aspects and lack which induces to their revision, waiting for a more efficient and positive role of the security conncil and the different other institutions of the United nations.
