استغلال براءة الإختراع بين الإحتكار و حرية المنافسة Exploiting The Patent Between Monopoly And Freedom Of Competition

الملخص

إن ﺃﻫﻤﻴﺔ ﺤﻘﻭﻕ الملكية الفكرية ﻋﻤﻭﻤﺎ ﻭ الصناعية ﻤﻨﻬﺎ ﻋﻠﻰ ﻭﺠﻪ الخصوص ﻤﻥ الناحية ﺍﻻﻗﺘﺼﺎﺩﻴﺔ ﻫﻲ التي ﺠﻌﻠﺘﻬﺎ ﺃﺤﺩ المحاور ﺍﻷﺴﺎﺴﻴﺔ التي ﺸﻐﻠﺕ المجتمع الدولي أثناء ﺇﺭﺴﺎﺌﻪ ﻷﺴﺱ النظام ﺍﻻﻗﺘﺼﺎﺩﻱ العالمي الجديد، و تعتبر براءة الاختراع أهم عناصر الملكية الصناعية نظرا لدورها الهام في تشجيع البحث العلمي و الابداع الذي ينعكس على التقدم الصناعي و التكنولوجي و كذا دورها ﺍﻻﻗﺘﺼﺎﺩﻱ ﻭ ﺍﻻﺠﺘﻤﺎﻋﻲ، و تعد من نتاج العقل البشري من مبتكرات جديدة تمنح لصاحبها الحق في احتكار الاستغلال ،و الذي يقوم على فكرة العدالة ،و يؤدي الى منع قيام المنافسة غير المشروعة، ﻭ ﻻ ﻴﺴﺘﻔﺎﺩ ﻤﻨﻬﺎ ﺇﻻ ﺇﺫﺍ ﺃﻗﻴﻡ ﻤﺸﺭﻭﻉ ﺼﻨﺎﻋﻲ لاستغلالها ﺃﻭ ﺒﻴﻌﺕ لمشروع ﻗﺎﺌﻡ ﻓﻌﻼ، و بالتالي فان صاحب الحق في البراءة يكتسب حقا حصريا و استئثاريا في احتكار استغلال براءة الاختراع قد يترتب عنه مساس بمبدأ حرية المنافسة بين المتعاملين الاقتصاديين ما لم يتم احترام الشروط و القيود الواردة على استغلال البراءة من طرف مالكها . It is the economic importance of intellectual property rights in general and of industrial property in particular that made it one of the main axes that occupied the international community while laying the foundations for the new global economic system. The patent is the most important component of industrial property due to its important role in encouraging scientific research and creativity. Which is reflected in industrial and technological progress as well as its economic and social role,It is a product of the human mind from new innovations that give its owner the right to monopolize exploitation, which is based on the idea of justice, and leads to preventing unfair competition, and only if an industrial project is established to exploit it or it is sold to an existing project, and thus The owner of the patent right acquires an exclusive and exclusive right to monopolize the exploitation of the patent, which may result in an infringement of the principle of freedom of competition between economic dealers unless the conditions and restrictions on the exploitation of the patent by its owner are respected
