جريمة التعدي على الملكية العقارية الخاصة في التشريع الجزائري

الملخص
ملخص: يقصد بالحماية مجموعة التدابير التي أقرها المشرع دفعا لأي اعتداء من شأنه المساس بالمصلحة خاصة كانت أو عامة على السواء و زعزعة الأمن العام ، و من أجل فرض النظام العام ، و لما كانت دراستنا منصبة حول الطابع الجزائي لهذه الحماية فحسب ، لذلك فهذا النوع من الحماية يتجسد في وسيلة التجريم لارتباط الجريمة بالعقوبة و هو تلازم منطقي يؤدي إلى تحقيق الردع العام و الخاص و تحول دون ارتكاب الجريمة من أي شخص كان في المجتمع و عدم تكرار الفاعل لسلوكه غير المشروع والهدف من سن هده النصوص هو المحافظة على الملكية العقارية الخاصة ضد أي اعتداء او إتلاف او تخريب عن طريق تقرير عقوبات جزائية ردعية لكل مخالف ،وبالتالي فان ترتيب العقوبة الجزائية يعد تأكيدا للحماية الجزائية المخصصة للملكية مما يشكل حصنا على التعدي عليها من طرف الغير ، من خلال أهم جريمة نص عليها المشرع الجزائري في قانون العقوبات وهي جريمة التعدي على الملكية العقارية الخاصة المنصوص عليها في المادة 386 منه . Abstract: Protection means the set of measures approved by the legislator in order to ward off any aggression that would prejudice the interest, whether private or public, and destabilize public security, and in order to impose public order. In the method of criminalization, the crime is linked to the punishment, and it is a logical correlation that leads to achieving public and private deterrence and preventing the commission of the crime by any person in the community and the non-repetition of the perpetrator of his illegal behavior. The goal of enacting these texts is to preserve private real property against any aggression or Destruction or sabotage by deciding deterrent penal penalties for each violator, and therefore the arrangement of the penal penalty is a confirmation of the penal protection assigned to property, which constitutes a bulwark against infringement by others, through the most important crime stipulated by the Algerian legislator in the Penal Code, which is the crime of infringement on real estate property The special provisions stipulated in Article 386 thereof.
