الرقابة الادارية على اعمال الادارة المحلية

الملخص
المشروعية في معناها العام تعني سيادة القانون أو الصفة لكل ما هو مطابق للقانون .و القانون هنا يقصد به المفهوم الواسع أي جميع القواعد القانونية . فمبدأ المشروعية يعني إذن أن تكون جميع نشاطات الإدارة العامة تمارس في حدود القانون ، أيا كان مصدره، مع مراعاة التدرج في قوته. ومراعاة لهذا المبدأ فإن الإدارة المحلية تمارس مهامها تحت إشراف الحكومة و رقابتها في ظل ما يعرف بمبدأ المشروعية أي خضوع الإدارة المحلية لضوابط و حدود قانونية فإقرار و اعتماد الرقابة الإدارية بنوعيها الرئاسية و الوصائية. والرقابة الرئاسية تتمثل في مجموعة من الاختصاصات يتمتع بها كل رئيس في مواجهة مرؤوسيه من شأنها أن تجعلهم تابعين له و.تتجسد من خلال سلطة الرئيس في تعيين المرؤوس و ترقيته و تسليط العقوبات التأديبية عليه فللرئيس كامل سلطة التنظيم الداخلي في حين أن الرقابة الوصائية تتمثل في مجموع السلطات التي يمنحها المشرع لسلطة إدارية عليا بهدف منع الهيئات اللامركزية من الانحراف و التحقق من مدى مشروعية أعمالها و الحيلولة دون تعارض قراراتها مع المصلحة العامة. Abstract Legality in its general meaning means the supremacy of the law or the attribute of everything that is in conformity with the law. And the law here means the broad concept, that is, all legal rules. The principle of legality, then, means that all activities of the public administration are exercised within the limits of the law, whatever its source, taking into account the gradation in its strength. Taking into account this principle, the local administration exercises its functions under the supervision and control of the government in light of what is known as the principle of legality, i.e. the local administration is subject to legal controls and limits. Presidential oversight is represented in a set of competencies that each president enjoys in facing his subordinates that make them subordinate to him. It is embodied through the authority of the president to appoint and promote the subordinate and impose disciplinary penalties on him. The president has the full authority of internal organization Whereas, custodial oversight is represented in the total powers granted by the legislator to a higher administrative authority with the aim of preventing decentralized bodies from deviation and verifying the legality of their actions and preventing their decisions from conflicting with the public interest.
