اتفاقيات التّعاون اللاّمركزي كأداة قانونية للجماعات الإقليمية لتكريس الحماية الوقائيّة للبيئة في القانون الجزائري

الملخص
الملخص: تهدف هذه الدراسة إلى تسليط الضوء على اتفاقيات التعاون اللامركزي، التي تبرمها الجماعات الإقليمية الجزائرية مع نظيرتها الأجنبية؛ والتي تعتبر بمثابة أداة قانونية خصّها بها المشرع الجزائري لمباشرة جميع نشاطاتها، وبما أن الجماعات الإقليمية مكلفة بحماية البيئة على المستوى المحلي، والحماية الوقائية تعد صورة من صور الحماية البيئية التي تحظى بأهمية كبيرة؛ باعتبارها أقل تكلفة، وأكثر فعالية ومحافظة على العناصر البيئية على حالتها الأصلية، وهي أفضل من علاج البيئة وإصلاحها. تأتي أهمية هذه الدراسة لمعرفة مدى فعالية اتفاقيات التعاون اللامركزي للجماعات الإقليمية في مجال الحماية الوقائية للبيئة في القانون الجزائري، ومدى توفيق المشرع الجزائري في التكريس القانوني لهذه الأداة القانونية، والمجالات البيئية التي تغطيها هذه الأخيرة. الكلمات المفتاحية: اتفاقيات التعاون اللامركزي، الجماعات الإقليمية، حماية البيئة، الحماية الوقائيّة للبيئة، القانون الجزائري. Abstract This study aims to shed light on the decentralized cooperation agreements concluded by the territorial communities Algerian with their foreign counterparts, which are considered as a legal tool designated by the Algerian legislator to carry out all their activities, and since the territorial communities are charged with protecting the environment on local level, and the preventive protection is a form of environmental protection, which are of great importance; as a less expensive, more effective and maintain the environmental elements of the original condition, a better treatment of the environment and repair. The importance of this study comes to know the effectiveness of the decentralized cooperation agreements of the territorial communities in the field of preventive protection of the environment in Algerian law, the extent of the Algerian legislator success in the legal devotion of this legal tool, and the environmental areas covered by the latter.
