الملخص
تسلط هذه الدراسة الضوء على أهم الطرق التي كرستها الممارسة التجارية في تسوية المنازعات التي قد تثور بين أطراف عقد التأمين البحري وهم بصدد تنفيذ عقد البيع الدولي للبضائع وتسليم البضاعة من البائع (الشاحن) إلى المشتري (المرسل إليه) عن طريق خدمات الناقل البحري، حيث لا يخفى على أحد مدى جسامة الأضرار التي قد تقع أثناء تنفيذ هذا النوع من العمليات الإقتصادية التي تؤدي في كثير من الأحيان إلى هلاك الأموال والأرواح فضلا عن السفينة ذاتها، ما يدفع أطراف هذا العقد إلى البحث دائما عن الآليات التي تلائم طبيعة هذا النشاط ويُستعان بها لجبر الأضرار التي تلحق بهم وتضمن لهم في ذات الوقت الحماية المعقولة التي تشجعهم على الإستثمار في هذا المجال المحفوف بالمخاطر. Abstract: This study sheds light on the most important methods devoted by commercial practice in settling disputes that may arise between the parties to the marine insurance contract while they are in the process of implementing the contract for the international sale of goods and the delivery of the goods from the seller (shipper) to the buyer (consignee) through the services of the marine carrier. Where it is not hidden from anyone how severe the damages that may occur during the implementation of this type of economic operations, which often lead to the loss of money and lives, as well as the ship itself. What prompts the parties to this contract to always search for mechanisms that are appropriate to the nature of this activity and which are used to redress the damages inflicted on them and at the same time guarantee them reasonable protection that encourages them to invest in this risky field.
